2. Ámbito de aplicación

Esta política se aplica a los negocios registrados, a los clientes y a los visitantes de alquimiasoy.com. Cumple con el Reglamento General de Protección de Datos (RGPD) de la Unión Europea y con la Ley 1581 de 2012 y sus decretos reglamentarios en Colombia.

3. ¿Qué datos recogemos?

Recogemos solo lo necesario para que la plataforma funcione.

De los negocios: nombre completo o comercial, correo, país, número de identificación fiscal (NIT/RUT o equivalente), datos de pago a través de Stripe (no almacenamos tu número de cuenta ni de tarjeta), información de tu perfil (biografía, foto, servicios, precios) e historial de ventas y comisiones.

De los compradores: nombre, correo, país, historial de compras y datos de pago a través de Stripe (no almacenamos tu número de cuenta ni de tarjeta).

De navegación: dirección IP, tipo de navegador y dispositivo, y cookies técnicas necesarias para el funcionamiento de la web.

4. ¿Cómo recogemos tus datos?

Directamente de ti cuando te registras o usas la plataforma; y de Stripe, que nos confirma que un pago se realizó correctamente, sin que nosotros almacenemos tus datos de tarjeta o cuenta.

5. ¿Para qué usamos tus datos?

Para gestionar tu registro y perfil; procesar pagos y comisiones; gestionar compras y reservas; enviarte comunicaciones sobre la plataforma; cumplir obligaciones legales (facturación, impuestos); y mejorar la plataforma. El uso de IA para redacción y recomendaciones se basa en tu consentimiento.

6. ¿Dónde almacenamos tus datos?

La base de datos de Alquimia se aloja en Frankfurt (Alemania), dentro de la Unión Europea, a través de Supabase, cumpliendo con el RGPD. Algunos proveedores que nos prestan servicios (por ejemplo, la inteligencia artificial y el alojamiento web) pueden procesar datos fuera de la UE; en esos casos la transferencia se realiza con garantías adecuadas (Cláusulas Contractuales Tipo de la UE), conforme también al Decreto 1377 de 2013 de Colombia sobre transferencias internacionales.

7. ¿Compartimos tus datos con terceros?

Solo con los proveedores estrictamente necesarios para que el servicio funcione:

Ningún tercero usa tus datos para sus propios fines: solo los procesan siguiendo nuestras instrucciones.

8. Uso de inteligencia artificial (IA) y transferencia internacional

Alquimia usa herramientas de IA externas ubicadas en Estados Unidos (Groq) para ayudar a redactar contenidos y generar recomendaciones.

¿Qué datos se comparten con la IA? Los contenidos generados por los negocios (descripciones, publicaciones) y las preferencias de los clientes (para recomendar). El nombre del negocio NO se comparte con la IA: internamente usamos un código (por ejemplo, «V1») en lugar del nombre real. Tampoco se comparten datos financieros (cuentas bancarias) ni datos sensibles (salud, religión, etc.).

La transferencia a Estados Unidos se cubre con las Cláusulas Contractuales Tipo (SCC) de la Unión Europea (Decisión de Ejecución (UE) 2021/914), que garantizan un nivel de protección equivalente al del RGPD y la Ley 1581 de 2012. La IA actúa como procesador bajo nuestras instrucciones.

9. ¿Cuánto tiempo guardamos tus datos?

Negocios: mientras tengas una cuenta activa. Si la cierras, conservamos lo necesario para cumplir obligaciones fiscales (facturación) durante 5 años (prescripción tributaria en Colombia). Clientes: 5 años desde la última interacción, para gestionar posibles reclamaciones. Puedes pedir la eliminación de tus datos en cualquier momento (derecho al olvido), salvo que la ley nos obligue a conservarlos.

10. Tus derechos (RGPD y Ley 1581)

Tienes derecho a acceder a tus datos, rectificarlos, suprimirlos (derecho al olvido), oponerte a ciertos usos y a la portabilidad. Para ejercerlos, escríbenos a alquimiaespiritu@gmail.com. Respondemos en un máximo de 30 días.

11. Seguridad de tus datos

Protegemos tus datos con: cifrado en las comunicaciones (HTTPS); cifrado en reposo de la base de datos; acceso restringido (solo personas autorizadas); verificación en dos pasos en las cuentas de administración; y copias de seguridad para evitar pérdidas.

12. Cookies

Usamos únicamente cookies técnicas necesarias para que la web funcione (por ejemplo, recordar tu idioma o tu carrito). No usamos cookies de seguimiento publicitario ni de análisis de terceros. La primera vez que visitas la web mostramos un breve aviso de cookies para informarte; puedes aceptarlo o rechazarlo. Si en el futuro incorporamos analítica u otras cookies no esenciales, lo indicaremos y pediremos tu consentimiento previo.

13. Cambios en esta política

Actualizaremos esta política si cambia la normativa o nuestra forma de operar. Te avisaremos con 30 días de antelación por correo si hay cambios importantes.

2. Scope of application

This policy applies to registered businesses, to customers and to visitors of alquimiasoy.com. It complies with the General Data Protection Regulation (GDPR) of the European Union and with Law 1581 of 2012 and its implementing decrees in Colombia.

3. What data do we collect?

We collect only what is necessary for the platform to work.

From businesses: full or trade name, email, country, tax identification number (NIT/RUT or equivalent), payment data through Stripe (we do not store your account or card number), your profile information (biography, photo, services, prices) and your history of sales and commissions.

From buyers: name, email, country, purchase history and payment data through Stripe (we do not store your account or card number).

Browsing data: IP address, browser and device type, and technical cookies necessary for the website to function.

4. How do we collect your data?

Directly from you when you register or use the platform; and from Stripe, which confirms to us that a payment was made correctly, without us storing your card or account data.

5. What do we use your data for?

To manage your registration and profile; process payments and commissions; manage purchases and bookings; send you communications about the platform; comply with legal obligations (invoicing, taxes); and improve the platform. The use of AI for drafting and recommendations is based on your consent.

6. Where do we store your data?

Alquimia's database is hosted in Frankfurt (Germany), within the European Union, through Supabase, in compliance with the GDPR. Some providers that offer us services (for example, artificial intelligence and web hosting) may process data outside the EU; in those cases the transfer is carried out with adequate safeguards (EU Standard Contractual Clauses), also in accordance with Colombia's Decree 1377 of 2013 on international transfers.

7. Do we share your data with third parties?

Only with the providers strictly necessary for the service to work:

No third party uses your data for their own purposes: they only process it following our instructions.

8. Use of artificial intelligence (AI) and international transfers

Alquimia uses external AI tools located in the United States (Groq) to help draft content and generate recommendations.

What data is shared with the AI? The content generated by businesses (descriptions, posts) and customer preferences (to make recommendations). The business name is NOT shared with the AI: internally we use a code (for example, «V1») instead of the real name. Financial data (bank accounts) and sensitive data (health, religion, etc.) are not shared either.

The transfer to the United States is covered by the European Union's Standard Contractual Clauses (SCC) (Implementing Decision (EU) 2021/914), which guarantee a level of protection equivalent to that of the GDPR and Law 1581 of 2012. The AI acts as a processor under our instructions.

9. How long do we keep your data?

Businesses: as long as you have an active account. If you close it, we keep what is necessary to comply with tax obligations (invoicing) for 5 years (tax limitation period in Colombia). Customers: 5 years from the last interaction, to handle possible claims. You can request the deletion of your data at any time (right to be forgotten), unless the law requires us to keep it.

10. Your rights (GDPR and Law 1581)

You have the right to access your data, rectify it, erase it (right to be forgotten), object to certain uses and to portability. To exercise them, write to us at alquimiaespiritu@gmail.com. We respond within a maximum of 30 days.

11. Security of your data

We protect your data with: encryption in communications (HTTPS); encryption at rest of the database; restricted access (only authorised persons); two-step verification on administration accounts; and backups to prevent losses.

12. Cookies

We use only necessary technical cookies for the website to work (for example, remembering your language or your cart). We do not use advertising tracking cookies or third-party analytics cookies. The first time you visit the website we show a brief cookie notice to inform you; you can accept or reject it. If we incorporate analytics or other non-essential cookies in the future, we will indicate it and ask for your prior consent.

13. Changes to this policy

We will update this policy if the regulations or our way of operating change. We will notify you 30 days in advance by email if there are significant changes.

14. Contact and supervisory authority

If you are not satisfied with our response, you can lodge a complaint with the Superintendency of Industry and Commerce (SIC) in Colombia, or with the data protection authority of your country in the EU (for example, the AEPD in Spain or the Autoriteit Persoonsgegevens in the Netherlands).

2. Toepassingsgebied

Dit beleid is van toepassing op geregistreerde bedrijven, op klanten en op bezoekers van alquimiasoy.com. Het voldoet aan de Algemene Verordening Gegevensbescherming (AVG) van de Europese Unie en aan Wet 1581 van 2012 en de bijbehorende uitvoeringsbesluiten in Colombia.

3. Welke gegevens verzamelen wij?

Wij verzamelen alleen wat nodig is om het platform te laten werken.

Van bedrijven: volledige naam of handelsnaam, e-mail, land, fiscaal identificatienummer (NIT/RUT of equivalent), betaalgegevens via Stripe (wij bewaren je rekening- of kaartnummer niet), je profielgegevens (biografie, foto, diensten, prijzen) en je geschiedenis van verkopen en commissies.

Van kopers: naam, e-mail, land, aankoopgeschiedenis en betaalgegevens via Stripe (wij bewaren je rekening- of kaartnummer niet).

Navigatiegegevens: IP-adres, browser- en apparaattype, en technische cookies die nodig zijn om de website te laten functioneren.

4. Hoe verzamelen wij je gegevens?

Rechtstreeks van jou wanneer je je registreert of het platform gebruikt; en van Stripe, dat ons bevestigt dat een betaling correct is uitgevoerd, zonder dat wij je kaart- of rekeninggegevens opslaan.

5. Waarvoor gebruiken wij je gegevens?

Om je registratie en profiel te beheren; betalingen en commissies te verwerken; aankopen en boekingen te beheren; je berichten over het platform te sturen; te voldoen aan wettelijke verplichtingen (facturatie, belastingen); en het platform te verbeteren. Het gebruik van AI voor het opstellen van teksten en aanbevelingen is gebaseerd op je toestemming.

6. Waar bewaren wij je gegevens?

De database van Alquimia wordt gehost in Frankfurt (Duitsland), binnen de Europese Unie, via Supabase, in overeenstemming met de AVG. Sommige leveranciers die ons diensten verlenen (bijvoorbeeld kunstmatige intelligentie en webhosting) kunnen gegevens buiten de EU verwerken; in die gevallen vindt de doorgifte plaats met passende waarborgen (EU-modelcontractbepalingen), eveneens in overeenstemming met het Colombiaanse Besluit 1377 van 2013 over internationale doorgiften.

7. Delen wij je gegevens met derden?

Alleen met de leveranciers die strikt noodzakelijk zijn om de dienst te laten werken:

Geen enkele derde partij gebruikt je gegevens voor eigen doeleinden: zij verwerken deze uitsluitend volgens onze instructies.

8. Gebruik van kunstmatige intelligentie (AI) en internationale doorgifte

Alquimia gebruikt externe AI-tools gevestigd in de Verenigde Staten (Groq) om te helpen bij het opstellen van content en het genereren van aanbevelingen.

Welke gegevens worden met de AI gedeeld? De door bedrijven gegenereerde content (beschrijvingen, publicaties) en de voorkeuren van klanten (om aanbevelingen te doen). De naam van het bedrijf wordt NIET met de AI gedeeld: intern gebruiken wij een code (bijvoorbeeld «V1») in plaats van de echte naam. Ook financiële gegevens (bankrekeningen) en gevoelige gegevens (gezondheid, religie, enz.) worden niet gedeeld.

De doorgifte naar de Verenigde Staten wordt gedekt door de modelcontractbepalingen (SCC) van de Europese Unie (Uitvoeringsbesluit (EU) 2021/914), die een beschermingsniveau garanderen dat gelijkwaardig is aan dat van de AVG en Wet 1581 van 2012. De AI treedt op als verwerker volgens onze instructies.

9. Hoe lang bewaren wij je gegevens?

Bedrijven: zolang je een actief account hebt. Als je het sluit, bewaren wij wat nodig is om te voldoen aan fiscale verplichtingen (facturatie) gedurende 5 jaar (fiscale verjaringstermijn in Colombia). Klanten: 5 jaar vanaf de laatste interactie, om mogelijke claims af te handelen. Je kunt op elk moment verzoeken om verwijdering van je gegevens (recht om vergeten te worden), tenzij de wet ons verplicht deze te bewaren.

10. Jouw rechten (AVG en Wet 1581)

Je hebt het recht om je gegevens in te zien, te corrigeren, te wissen (recht om vergeten te worden), bezwaar te maken tegen bepaalde vormen van gebruik en op overdraagbaarheid. Om deze uit te oefenen, schrijf ons op alquimiaespiritu@gmail.com. Wij reageren binnen maximaal 30 dagen.

11. Beveiliging van je gegevens

Wij beschermen je gegevens met: versleuteling van de communicatie (HTTPS); versleuteling in rust van de database; beperkte toegang (alleen bevoegde personen); tweestapsverificatie op de beheeraccounts; en back-ups om verlies te voorkomen.

12. Cookies

Wij gebruiken uitsluitend noodzakelijke technische cookies om de website te laten werken (bijvoorbeeld om je taal of je winkelwagen te onthouden). Wij gebruiken geen advertentie-trackingcookies of analysecookies van derden. Bij je eerste bezoek tonen wij een korte cookiemelding om je te informeren; je kunt deze accepteren of weigeren. Als wij in de toekomst analyse of andere niet-essentiële cookies toevoegen, zullen wij dit aangeven en vooraf om je toestemming vragen.

13. Wijzigingen in dit beleid

Wij zullen dit beleid bijwerken als de regelgeving of onze werkwijze verandert. Wij zullen je 30 dagen van tevoren per e-mail op de hoogte stellen als er belangrijke wijzigingen zijn.
